Why Losing Virginia DMV Demerit Points Is a Big Deal

Losing demerit points seems like something that only happens at boarding school. However, in Virginia, if you are convicted of reckless driving, the loss of six DMV demerit points isn't child's play; and it can cost you more than you know.

If you already have negative demerit points, a reckless driving conviction in Virginia can lead to the temporary loss of your license. In addition, the more demerit points you have, the less likely an officer is to "let you off with a warning" should you be pulled over again.

If your case goes to trial, any negative demerit points on your license will increase the chance that the judge will give you a more severe punishment. The high loss in points can have a snowball effect, causing you to lose more points, increasing the likelihood of higher fines, even jail time.

Demerit Points Are Not the Only Consequences of a Reckless Driving Ticket
Facing a Virginia reckless driving citation? The bad news is that you don't just have to worry about losing six demerit points. If you are convicted of this Class 1 Misdemeanor, your insurance rates will increase, you will pay a fine of up to $2,500, and you may lose your job or any security clearances you have.

If you got a reckless driving ticket in Virginia, it really is a big deal, affecting much more than your driving record. For the help you need to fight a reckless driving ticket in Virginia, call an experienced, aggressive Virginia Beach traffic ticket lawyer at 757.625.1214.

If you decide to fight your reckless driving ticket without the help of an attorney, please consider the following things:

In Virginia, a reckless driving ticket is a Class 1 Misdemeanor. This mean that a conviction can impact your current job, your future employment, and any security clearances you have.

You can be fined up to $2,500 dollars.

You can lose six Virginia DMV demerit points.

Your insurance costs can skyrocket.

The tickets can cause you to temporarily lose your drivers license.

Is the Cost of a Lawyer Worth It?
Our Virginia Beach traffic ticket lawyers have worked with many people who would have lost their jobs, their licenses, and a whole lot of money had they not hired us. While many other traffic-related tickets don't come with severe penalties, reckless driving does; and a reckless driving conviction in Virginia has the potential to have a profoundly negative impact on your life.

While you have the right to fight your Virginia reckless driving ticket on your own, are you prepared to deal with the consequences if you should fail? While it does cost money to hire a lawyer, a guilty verdict has the potential to cost you much more than the possible $2,500 fine.

With the help of an attorney, you have a good chance of either getting a verdict of not guilty or of getting the ticket reduced from reckless driving to improper driving. This infraction comes with a fine no higher than $500 and you will lose three—not six—DMV demerit points.

For experience you can trust, please call a Virginia Beach traffic ticket lawyer at 757.625.1214 and schedule your free consultation today. You have nothing to lose, and everything to gain.

Did You Buy a House in Virginia, Only to Find It Has Major Defects?

If you bought a defective home, you are more than disappointed: you are angry, and rightfully so. But what can you do about it? Is there someone you can sue? The home inspector? The sellers? The contractor who built the house?

The answer to all of these questions is: Maybe. Without knowing the particulars of your case it is impossible to determine if someone is at fault for selling you a defective home. However, as experienced Virginia Beach real estate lawyers, we can say that if you are at all suspicious that someone misled you in the purchase of your home, you have the right to speak with an attorney.

Knowing Your Rights as a Home Buyer
There are several legal options for those who have bought a home, only to discover that the house has major flaws or defects. Some of the more serious of these flaws and defects include:

Infestation of termites

Extensive water damage

Mold

Structural damage

Faulty foundation

Gas leaks

Dangerous fireplace

Faulty siding or roofing

We could go on and on, listing the types of dangerous, undisclosed problems we have seen. However, what matters is this: if the seller of your home intentionally tried to hide serious damage or flaws in the house, there is a chance he or she can be held liable. An experienced Virginia residential law attorney can hold the seller accountable for your defective Virginia home. A successful lawsuit or settlement means that you can get money you need to pay for repairing the damages to your home.

You do not have to "suck it up" and pay for costly repairs to your new home. Please call an experienced, aggressive Virginia Beach real estate lawyer at 757.625.1214 to schedule your FREE consultation. Unlike your home, your anger may have a good foundation; please call today.

Why It's Important to Know About Grounds for Divorce in Virginia

If you are considering getting a divorce, learning more about divorce laws in Virginia can help you make the right decision. As with most things in life, the more you know, the better able you are to make a well-informed decision.

Those considering getting a divorce in Virginia should know that there are two options available: a divorce from bed and board and a divorce from bond of matrimony. A divorce from bed and bond allows the couple to separate, but not to remarry and to go ahead with their marriage if the situation improves. If, after a year's time, the couple wants to divorce fully, they can file for a divorce from bond of matrimony. A divorce from bond of matrimony can be filled without a divorce from bed and bond.

Beyond the Basics
However, there is much more to filing for a divorce than just knowing the two types of divorce Virginia law allows. As Virginia Beach divorce attorneys, we know that the divorce process can be long and full of confusing legal jargon. We believe that it is our job not only to give you stellar legal assistance, but also to help you better understand the divorce process.

At the Virginia Beach divorce law firm of Tavss Fletcher we want you to fully understand the way divorce works in Virginia. We want to ensure that your interests—and the best interests of your children—are protected as well as possible.

If you are ready to file for divorce in Virginia or just want to learn what your options are, call 757.625.1214 to speak with a Virginia Beach divorce attorney with the compassion and experience to help you through this often trying process.
While it is true that there are cases of minor road rash, we have had many clients who have been hurt during a motorcycle crash in Virginia Beach with road rash that is MUCH more than a minor injury.

We have seen motorcycle accident victims who are in the process of undergoing a series of serious medical treatments for road rash injuries. Too often, the injury takes off enough skin to warrant stitches and skin grafts. Due to the possibility of debris embedded in the skin, infection is a serious risk with road rash injuries. In addition, there are times when the injury is deep enough to damage nerves and muscles.

The Impact of Road Rash on Motorcycle Accident Victims

When a road rash injury is severe, it can cause permanent damage. The crash victim may lose some function in the affected limb, and extreme scarring is a real possibility.

The medical care required to treat a serious case of road rash is expensive. In addition, insurance companies may refuse to pay for the ongoing care needed to recover from the injury.

If you have been hurt during a motorcycle accident in Virginia Beach and the insurance company has offered you compensation, our Virginia Beach motorcycle accident attorneys urge you: Do not sign on the dotted line.

If you sign, and then find that the amount you have received is not enough to pay your bills, it may be too late to get the money you need.
Have You Talked to Your Teen Driver About Overcorrecting?

As a Virginia Beach car accident attorney I know that new drivers tend to make some pretty terrible driving mistakes. One of the most dangerous mistakes that teen drivers make is one that you might not have thought of: overcorrecting.

When a new driver finds themselves off the road, they almost always react by panicking and jerking the wheel to one side. However, this gut reaction is dangerous and causes hundreds of teen driving accidents each year. In too many of these crashes, speed is also a factor and teen drivers, passengers and other motorists are injured, even killed. All because of one rookie driving mistake.

What we can do to Prevent Teens Drivers From Overcorrecting

Some good advice has come out of discussions between driving experts, police and other concerned citizens. This advice centers around teaching teens the correct way to get out of an "off the road event" and how to prevent it from happening in the first place. Prevention advice includes:

Drive with hands at "8" and "4" instead of "10" and "2"

Practice the right way to correct an off the road event in a safe location, at low speeds, with an experienced driving instructor

Avoid driving off the road by keeping eyes focused on the road (don't be a distracted driver)

The Virginia Beach car accident attorneys at Tavss Fletcher hope that you and your teen driver are able to use this information to improve your driving skills and possibly prevent a serious car accident.

We know that you do your best to drive safely, but what about other drivers?

If you have been hurt during an accident in Virginia Beach, be sure that the insurance company gives you the money you need to recover your losses. Don't settle for less than your case is worth; call 757.625.1214 today to schedule your free consultation.

When Will Doctors, Nurses, Stop Making Mistakes?

More than likely, there will never be a time when hospital staff members never make mistakes. However, this is no excuse for the high number of dangerous, even deadly mistakes being made at hospitals in Virginia and across the nation.

How is it that a hospital, meant heal the sick, can actually injure and kill so many people? Human error is surely a factor, but why don't hospitals have better ways of reducing the incidence of these types of errors?

Parallels to Airline Industry

In the airline industry, safety violations are taken very seriously. If a pilot or mechanic makes a mistake, they are not only reprimanded, they may very well be fired. Because of these stringent safety standards, crashes are relatively rare. Why shouldn't doctors be held to the same level of accountability?

Each year, the number of people killed by a medical mistake in the hospital equals the number of people who would die if four jumbo jets crashed each week for the entire year. If this type of event happened in the airline industry, airplanes would be grounded and a full investigation launched.

Thousands of preventable hospital deaths occur each and every day. Where is the outcry? Why are doctors and nurses not being pulled from duty? Why aren't hospitals being "grounded"?

Holding Doctors, Nurses and Hospitals Responsible for Their Actions

At the Norfolk, VA law firm of Tavss Fletcher, we have seen the terrible impact hospital mistakes have on patients and their families. These mistakes should not happen, and as experienced Virginia medical malpractice attorneys we work hard to shine a light on the terrible mistakes that hospitals make.

If you have been injured while under medical care, or you lost a loved one due to a medical mistake, you do not have to accept it and move on. Filing a medical malpractice lawsuit in Virginia is one of the best ways to ensure that the hospital responsible for your losses pays for their mistake.

A medical mistake is always terrible. When the medical error surrounds the birth of a child it is all the more appalling. Recently, we reported on a woman who suffered brain damage after the doctor performed a faulty c-section and thehospital staff failed to identify her worsening condition.

Her partner called nurses, attempting to get help for the mother of his newborn child, yet they did nothing to help stabilize her erratic blood pressure and heart rate. By the time they took notice, some six hours after the surgery, the woman was gravely ill, her bed sheets covered in blood.

During this time the mother had lost over half of the blood in her body. One simple check could have prevented this, yet the nurses and doctors did not bother to simply lift a sheet and check her incision. They did not bother to wonder why her vital signs were fluctuating and instead noted that the new mother was "resting comfortably."

An Inexcusable Tragedy

While the mother survived the terrible incident, she was left with permanent brain damage.
Alhough you might think that Attack of the Killer Computers is another bad movie on the sci-fi channel, the truth is that so called "Health IT" may be doing more harm than good. While you may not have to worry about a computer growing legs and attacking, you should be concerned that an error in the program used to keep your medical records could do harm.

When Computers Make Mistakes, Patients in Virginia are Harmed

For many years, people believed that computer based medical records, also known as Health IT, would help prevent doctor, nurse, and hospital errors. Although a typed entry on a patient’s record or a printed prescription factors out illegible doctor handwriting, there are other mistakes being made that are injuring and killing patients. Some of the more serious errors include:

Dosing errors (wrong numbers typed into program)

Failure to detect life-threatening illness (missing information)

Delaying treatment (poor human-computer interactions)

Loss of data (deleted entries or computer failure)

Searching for a Solution

Many believe that the primary problem with Health IT is that the industry is not properly regulated. Currently, there are no official regulations or standards that apply to Health IT. This means that anyone who creates an electronic medical record program can sell it to doctors and hospitals, even if the program is flawed.

As medical malpractice attorneys, we are concerned about the rising number of medical mistakes made in Virginia because of computer-based medical records systems. We hope that continued research and patient advocacy will force IT companies to make programs that work. Too often, however, patients must die or suffer before the issue is addressed.

If you are the victim of a medical mistake in Norfolk, do not hesitate to contact an attorney at Tavss Fletcher.
VA Drug Counselors May Help Those Freed Under Fair Sentencing Act

Many worry that the combination of reduced sentencing in crack cocaine cases and the early release of inmates under the retroactive application of the Fair Sentencing Act will turn areas of Virginia back into the crack havens they were in the 1980s. Others are cheering the change; they are glad to see an end to an unfair and even racist crack cocaine sentencing policy.

Strategies for Successful Early Release

Because of the numerous recent early releases, drug counselors are working to help the released stay away from old haunts and habits, instead focusing on a new, crime-free life. Kerry Black Wiles is an experienced, award winning drug counselor. She is confident that, with the right treatment program, these individuals can have success after prison.

"One of the keys for them will be to avoid, as we say, ‘Your same playmates, your same playgrounds,'" Wiles said. "These are part of the skills we try to teach in recovery programs. The trick will be to make sure we continue to work with the judicial and correction system to get those coming out on drug-related charges into the right kinds of treatment programs."

The hope is that anyone released under the Fair Sentencing Act will be given the support they need to make the most out of the time they have been given back.

If you need help after being released in Virginia or need legal advice about applying for early release under the Virginia Fair Sentencing Act, please contact an experienced Virginia Beach criminal law attorney at Tavss Fletcher today for your free consultation.

Cheers and Fears Abound as Virginia Inmates Go Free

There have been two very distinct reactions to the news that thousands of inmates imprisoned for charges related to the use or distribution of crack cocaine are being released. In Virginia, the issue is especially prominent as the eastern district of Virginia is releasing the highest number of affected inmates in the county. In this district alone, 75 inmates will be released today under the Fair Sentencing Act of 2010.

On One Side: Cheers

Families of the prisoners, defense attorneys, and those concerned with the rights of minorities are relieved that the too-strict sentencing of those in possession of crack cocaine has been reversed. They point to the fact that the now defunct law punished those in possession of crack cocaine 100 times more severely than those in possession of the powdered form.

In general, black defendants had been caught with crack while white defendants were most often found with powdered cocaine. Many see the reversal as justice served to those who long suffered under an unfair, prejudiced law.

On the Other Side: Jeers

Others are concerned that the release of some 12,000 inmates over the next few years will drive up the rates of drug and violent crimes where the released prisoners settle. They also fear that less strict sentencing will drive up use and sales of crack cocaine.

However, for those who have missed loved ones, and for the imprisoned who are ready to reenter society and make a change for the better, the Fair Sentencing Law is the answer to their prayers. The sister of an inmate who is about to be released spoke about just how serious her brother is in making the best use of his early release.

"He wants to get out, get a job and get his life back together," said Susan Cardwell, sister of soon to be released Darryl Flood. "He says he'll work two jobs if he has to."

The Norfolk, Va. criminal law attorneys at Tavss Fletcher are glad to see the Fair Sentencing Act being implemented.
Virginia Drivers, Are You Guilty of Neglecting Your Child?

The most common form of child abuse has nothing to do with physical punishment or malnourishment. In fact, you may be guilty of it and not even know it.

To many people, allowing your child to ride in the car without a proper car seat is as good as child abuse. Before you argue, consider this: the leading cause of death in children is not cancer, illness, or any other kind of disease. The leading cause of death in children is car accidents.

Safety experts argue that if you are not properly restraining your child while in the car, you are leaving them vulnerable to serious injury, even death. While we tend to worry about illnesses that are out of our hands, we too often forget that we have the power to help protect the lives of our children every time they get into a car.

Keeping your child safe while in the car is the best way to prevent accidents and injuries. New AAP recommendations state that children under the age of 2 should remain rear facing in car seats. After this, children should be restrained by a five-point harness until they reach the seat's weight or height limit. The next step is a booster seat which, again, should be used until the child exceeds the manufacturer's recommended height or weight.

Only you can ensure that your child is properly restrained. The staff and Virginia accident attorneys at the Norfolk accident law firm of Tavss Fletcher urge you to learn more about the right seat for your child and use it each and every time you get in the car.
Crisp cool air, crystal clear blue skies above, and breathtaking fall foliage all around. As a biker in Virginia you are fortunate enough to have all this and more - right in your backyard! Years ago, the Blue Ridge Parkway was named "America's Favorite Drive," and the 469 miles live up to this name. The Blue runs from the Great Smoky Mountains National Park in North Carolina and Tennessee to the Shenandoah National Park in Virginia. Each year, without fail, it offers some of the most stunning views in the nation.
Get the Fall Fun While It Lasts

Fall seems only a fleeting moment to those of us dreading winter; however, it is the perfect time to see the best that Virginia and North Carolina have to offer. If you time your ride just right, you can witness one of the most amazing feats of nature on the planet: the annual migration of the monarch butterflies. In early fall, thousands of these winged beauties make a stop just south of Asheville, North Carolina. After you check out the butterflies, hop back on your motorcycle and head to the Wagon Road Gap overlook. Many think that this North Carolina spot offers the most beautiful views along the Blue Ridge Parkway. No matter what section of the scenic route you choose, take advantage of your surroundings and hit the highway.

Why We Think Motorcycles Are THE Way to Travel

As a motorcyclist, you are able to enjoy roadways such as the Blue Ridge Parkway in ways that drivers cannot understand. Our Virginia motorcycle attorneys don't think that there is any better way to see, feel, and become a part of one of nature's greatest shows. So check your safety gear, watch for drivers distracted by fall foliage, and get out there and ride, Virginia!

While injuries are par for the course in the world of professional wrestling, two professional wrestlers have recently been involved in accidents outside of the ropes. Both accidents occurred in North Carolina and both have led to possible drug/alcohol charges.

The first accident occurred in May when former wrestler Shane Helms and his girlfriend crashed their motorcycle after leaving a NC restaurant. Helms and his passenger were seriously injured and Helms has just been charged in North Carolina with a DWI stemming from the crash.

The second was more recent and involved wrestler Matt Hardy. Hardy crashed his 2009 Chevrolet Corvette into a tree early Saturday afternoon. Police report that while it didn't appear that Hardy had been drinking, he seemed to have taken some type of impairing substance. Hardy agreed to a blood test and will appear in court on Sept. 28th.

Why the sudden rash of pro wrestler accidents in North Carolina?

While there is no right answer to this question, it does seem that both accidents were caused, in part, by drugs or alcohol. The WWE offers drug and alcohol abuse help for both current and former wrestlers. If drug or alcohol abuse is an issue for either young man, the criminal law attorneys at Tavss Fletcher hope that the men get the help they need and recover fully from injuries sustained during the crashes.

If you have been involved in an accident we can help.
In Virginia, in 2010 alone, 88 people lost their lives while cycling or walking. An additional 621 bicyclists and 1,858 pedestrians were hurt. While we all know that biking and walking are good for your health, there are some undeniable dangers to riding, walking and running along roadways.
How Virginia Police are Working to Prevent Accidents

In order to combat the rash of bicycle and pedestrian accidents across Virginia, this week has been named Virginia's Bicyclist and Pedestrian Awareness Week. For the third year in a row, police in Culpeper and across Va. will be placing electronic message boards, increasing police presence near crosswalks and reminding the public that they must share the road with bikers and walkers.

"Pedestrians have the right-of-way in crosswalks and motorists need to pay attention and stop," said Culpeper Police Chief Chris Jenkins.

Saving Lives Through Bicycle Helmet Use in Virginia

Across the state, police, in conjunction with Drive Smart Virginia and BikeWalk Virginia, have been offering helmets to those who need them. The hope is that increased helmet use will help lower the number of bikers seriously injured or killed during an accident. Head trauma is a leading cause of permanent injury and death for bicyclists involved in an accident.

What You Can do to Prevent an Accident in Virginia

The staff and attorneys at the Norfolk accident law firm of Tavss Fletcher hope that you take this week of pedestrian and bicyclist safety seriously. As a driver you are responsible for keeping your eyes on the road at all times and always looking for walkers or bikers before you make a turn. If we all carry this message of awareness and accident avoidance with us throughout the year, we can help stop a serious accident before it happens.
