Under Virginia Code §18.2-346, it is considered a solicitation of prostitution to offer money or something equivalent with the intent that a sexual act be performed, and there was a substantial act in furtherance of the offer. No sexual contact has to occur for this crime to have been committed.
- Aiding prostitution. Virginia Code §18.2-348 makes it a crime to aid in prostitution or illegal sexual intercourse. The accused must know or should have known that they are transporting an individual to a place of prostitution. They can also be charged with aiding prostitution if they provide information on how to procure prostitution with the intent that the prostitution occurs.
Penalties for Prostitution
Prostitution offenses are a Class 1 misdemeanor in Virginia. If convicted, you could face these punishments:
- Up to 12 months in jail
- Fine of up to $2,500
