Injuries and Accidents
Injuries and accidents are a fact of life – they happen every day and in so many ways. Sometimes “accidents happen”, but more often than not an accident occurs for a reason. Very often accidents happen because someone was careless or not paying attention – and that someone should be held responsible. If you are reading this, you may have been seriously injured in an accident, or affected by a serious accident which a family member or other loved one is suffering from. You may be looking for justice and seeking help with the fallout from that accident, but you aren’t sure where to turn.

Understanding Injury Accident Cases
If you’ve been injured in an accident, collecting all of the important information is key. It is very important to record as much information as possible, including the time, date, location, a detailed description of what happened, the contact information for any witnesses, and any information you have about the responsible person(s). You should also refrain from signing any documents or speaking to the responsible person’s insurance company until you have consulted with an attorney yourself. Sometimes, even helpful information you provide after an accident can later be used against you. If you have signed any documents or spoken to the responsible party or their attorney, be sure to let your attorney know when you first speak to him.
To successfully recover damages from the person or company who caused the accident, you must be able to show that the person or company was negligent, which means that you must be able to show:
- That the person who caused the injury owed you a legal duty at the time
- That the person who caused the injury failed to carry out that duty
- That you suffered damages, or were injured in some fashion, and
- That these damages were caused as a result of this person’s failure to carry out his or her duty
If you were injured by a defective product, in order for you to recover damages you must establish that:
- The product that injured you was defective in its manufacture or design, or there was no adequate warning given to you of the product’s potential dangerousness, and
- The defective manufacture or design of the product, or its lack of adequate warnings, caused you damages, or injuries
In Virginia and North Carolina, if more than one person was responsible for your accident, each person can be held accountable for the total amount of damages under the principle of joint and several liability.

- Road Rage: When extreme emotion leads to serious crashes
Description: Road rage – the type of behavior that aggressive drivers engage in to the detriment of those around them – is a serious issue for Virginia drivers. According to a recent 2009 Road Rage survey by AutoVantage, drivers respond to other people’s bad driving with their own questionable behavior. In the survey drivers admitted to honking, cursing, gesturing and even slamming into the rear of another car. - Medical conditions that can lead to serious car accidents
Description: Driving while impaired by a serious medical condition can have disastrous results. The recent death of a motorist who experienced an unexpected medical event is an example of how health issues can impair a person’s ability to drive safely. Certain health conditions put people at risk of causing a serious car accident, putting themselves and others on the road in danger. - Do red light cameras really prevent car crashes in Virginia?
Description: Red light running is a problem in many cities, and Virginia Beach is no exception. Experts claim that they can reduce the number of serious and deadly front-to-side impact crashes in intersections, saving lives and cutting down on emergency healthcare costs. However, other studies and skeptics suggest that the cameras are not the panacea advocates claim them to be. - Virginia Motor Vehicle Accident Statistics
Description: Statistics and analysis of Virginia motor vehicle accidents are maintained by the Virginia Department of Motor Vehicles and published annually. This document contains key information from the 2007 Traffic Crash Facts document produced by the Virginia DMV Highway Safety Office. - Drowsy Drivers Can Kill
Description: You won’t find many people in Virginia who think that driving while intoxicated is okay, but few people give a second thought to driving while tired. Research tells us that drowsy drivers actually perform worse on driving tests than intoxicated drivers, yet the issue receives little attention from lawmakers and law enforcement officials. If you’ve been injured in a car or truck crash, you may be wondering if the other driver was too tired to be behind the wheel. Find out what factors put a driver at risk of being too tired to drive and how you can avoid becoming a drowsy driver yourself. - How much do you know about your car’s little black box?
Description: Have you ever wished there was a way to prove that the driver of the car that hit you was in driving in an unsafe manner? Believe it or not your wish could come true if the other driver’s car contained an event data recorder (EDR). EDRs are now standard on most vehicles sold in the United States, and they typically record vehicle information like speed, direction, seatbelt use and more just before and during a crash event. - Vehicle Event Data Recorders: Big Brother is Watching
Description: Event Data Recorders (EDRs) are becoming standard equipment on vehicles sold in the United States, but few people know what they are. These devices are part of the airbag control module and record information in the case of an auto crash. In order to standardize EDR devices, the federal government has stepped in and is requiring vehicle manufacturers to follow guidelines for all EDRs installed in model year 2013 vehicles. As a result, EDR data should safely sustain a crash event, be easier to retrieve, and contain standard information of use to accident investigators and vehicle safety researchers. - The challenge posed by aggressive drivers on Virginia roads
Description: We all know what aggressive driving looks like. Drivers who swerve in and out of lanes, follow too closely, make rude hand-gestures when they don’t get their way, speed, and ignore traffic control devices are all guilty of aggressive driving. The challenge in Virginia is that despite laws against aggressive driving, it is difficult to charge someone with what is essentially a subjective offense. Read more about the challenge that aggressive drivers pose to law enforcement officers and what you can do if you find yourself on the road with one of these drivers. - What to do after an Auto Accident in Virginia
