Does Virginia Law Require Ignition Locks for First Time DUI Offenders?

Posted on Feb 20, 2012

Currently, DUI laws in Virginia only require that repeat offenders and first time offenders whose blood alcohol content is almost twice the legal limit have interlock systems installed on their vehicles; however, if two bills pass the Virginia Senate this may change.

First-Time DUI Offenders May Soon be Subject to Vehicle Interlocks

Del. Salvatore Laquinto and Sen. Donald McEachin have both drafted proposals that would require interlock devices for first time DUI offenders. If the bills pass, first-time drunk drivers would have to pay to lease an interlock device from the state.

The cost of the lease is approximately $80 per month and those convicted of a DUI would need to have the interlock for the length of their license restriction, which is generally six months. This cost would be added to already steep fines and fees associated with a DUI in Virginia.

So far, SB378 narrowly passed through a Senate committee. This is notable progress as similar measures have stalled in committee, never making it to the Senate for a vote. Del. Laquinto is hopeful that the law, if passed, will, “protect the lives of Virginia citizens on the road.”

Supporters of the bill include law enforcement agents and safe driving advocates. Both were on hand when Laquinto announced that the bill has made its first step toward becoming a law. Many are hopeful that the law can help reduce the number of people injured and killed by drunk drivers each year. Last year, 274 people lost their lives and over 5,000 were injured during an accident with a drunk driver in Norfolk and across Virginia.

The Norfolk, VA criminal law attorneys at Tavss Fletcher would like to see the number of people killed and injured during accidents with drunk drivers decrease dramatically. We hope that the law, if passed, will lower the rate of Virginia drunk driving accidents while maintaining the rights of the accused.
