Penalties for Virginia Marijuana Possession, Cultivation or Sale

Possession of marijuana

  • Any amount, first offense: misdemeanor, possible 30 days in jail, $500 fine
  • Any amount, later offenses: misdemeanor, possible 1 year in jail, $2,500 fine

 

Cultivation of marijuana

  • Any amount, any offense: felony, five to thirty years in jail, $10,000 fine

 

Sale of marijuana

  • Half ounce or les: misdemeanor, possible one year in jail, $2,500 fine
  • Half ounce to five pounds: felony, one to ten years in jail, $2,500 fine
  • Five pounds to 100 kg: felony, five to thirty years in jail, $2,500 fine
  • Over 100kg: felony, twenty years mandatory minimum sentence, $1,000,000 fine
  • Sale to a minor: felony, 10 to 50 years in jail, $100,000 fine
  • Sale within 1,000 feet of a school or other specified area: felony, one to five years in jail, $100,000 fine
  • Brining five pounds or more into Virginia with the intent to sell: felony, three years mandatory minimum sentence to forty years, $1,000,000 fine

 

Sale of marijuana paraphernalia

  • Sale of paraphernalia: misdemeanor, one year in jail, $2,500 fine
  • Sale of paraphernalia to a minor: felony, one to five years in jail, $2,500 fine

 

In addition, any marijuana conviction in Virginia will result in a six month driver’s license suspension.
